Terms of Service
These terms cover your use of Din on iOS and Android. The section that matters most is the third one: Din is a good everyday estimate of how loud things are, and it is not a certified instrument. Please read it before relying on a reading for anything consequential.
The short version
- Din is free to use, with no subscription, no ads and no account.
- Din is not a certified sound level meter — do not use it as the sole basis for a legal, occupational or safety decision.
- Sound-dose figures are general information, not medical advice.
- Your recordings live only on your device; we never receive them and cannot recover them.
- Din is provided “as is”, and our liability is limited as set out below.
This summary is for orientation only. The numbered sections below are the operative terms.
1. Agreement to these terms
These Terms of Service (“Terms”) form an agreement between you and BaruzoTech (“we”, “us”) covering the Din mobile application for iOS and Android, and this website (together, the “Service”).
By downloading, installing or using Din you accept these Terms. If you do not accept them, do not use Din — and if you have already installed it, uninstall it.
Our Privacy Policy is incorporated into these Terms by reference.
2. Your licence to use Din
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use one copy of Din on devices you own or control, for your own purposes, whether personal or professional. We keep all rights we do not expressly grant you.
You may not:
- copy, sell, rent, sublicense or otherwise distribute Din, except as the app stores permit through their own family-sharing features;
- reverse engineer, decompile or disassemble Din, except to the extent that applicable law expressly permits despite this restriction;
- remove or obscure any copyright, trade mark or other proprietary notice;
- use Din to break the law, to harass anyone, or to record people covertly where doing so is unlawful in your jurisdiction.
Din, its name, its logo and its design are our property or that of our licensors, and are protected by intellectual property law.
3. Measurement accuracy — what Din is not
Din is not a certified sound level meter.
Din uses your phone's microphone, so readings are estimates — tuned for everyday accuracy, but not a replacement for a certified sound level meter in legal or industrial settings.
Din reads the microphone that is built into your phone. Those microphones are engineered for speech, not metrology. They vary between manufacturers, between models and between individual units; they compress or clip very loud sounds; and their response changes with a case, a pocket, wind, or a fingertip over the port.
We tune Din to be dependable for everyday judgements — is this room loud, is this venue risky, is my flat quieter than the street outside. We do not represent that it meets IEC 61672, ANSI S1.4, or any other instrument standard, and it holds no calibration certificate.
You must not rely on Din as the sole or decisive basis for any occupational safety determination, regulatory compliance assessment, legal proceeding, insurance claim, or engineering decision. Where a measurement carries legal, industrial or safety consequences, engage a qualified professional using calibrated, certified equipment.
The optional calibration offset lets you align Din with a reference instrument on your specific device. Using it improves agreement with that instrument; it does not make Din a certified meter.
4. Hearing health information is not medical advice
Din presents daily sound-dose figures derived from published occupational exposure standards — the NIOSH recommended exposure limit (85 dB over eight hours, 3 dB exchange rate) and the OSHA permissible exposure limit (90 dB over eight hours, 5 dB exchange rate).
These are population-level occupational guidelines. They are provided for general information and are not medical advice, diagnosis or treatment, and not a substitute for a qualified professional. Individual susceptibility to noise-induced hearing loss varies considerably, and a dose reading below 100% is not a guarantee that your hearing is unaffected.
If you have ringing in your ears, muffled hearing, ear pain or any concern about your hearing, consult a doctor or audiologist. Do not delay seeking care because of something Din displayed.
Likewise, nothing in Din constitutes legal advice. A saved recording may be useful supporting material in a noise complaint, but whether it is admissible or persuasive is a matter for the relevant authority and, if necessary, your lawyer.
5. Recording, privacy and your responsibilities
Din does not capture audio — it derives a loudness figure and discards the sound, as described in our Privacy Policy. Even so, laws in some places regulate the act of monitoring sound in private spaces or in workplaces.
You are responsible for using Din lawfully where you are, including any notice or consent obligations that apply to monitoring in your home, workplace or a shared building. You are also responsible for how you use any report or CSV you export, including any obligations that attach to sharing it with a landlord, employer or authority.
6. Your recordings and content
Session names you type and the readings Din saves are yours. They are stored on your device, we never receive them, and we claim no rights over them whatsoever.
Because that data lives only on your device, keeping it is your responsibility. Deleting a session, clearing the app's data, uninstalling Din, or losing or resetting the device will remove it permanently. We cannot recover it, because we never had a copy. Export anything you need to keep.
7. Price, availability and changes
Din is provided free of charge. There is no purchase price, no subscription, no in-app purchase, no advertising and no paid tier.
We may change, suspend or discontinue any part of Din at any time, and we may stop supporting particular operating system versions or devices. We are not obliged to provide updates, maintenance or support, and we may withdraw the app from either store. Because Din runs locally and stores nothing remotely, an app that is already installed will generally keep working — but we do not promise that.
8. Disclaimer of warranties
To the fullest extent permitted by applicable law, Din is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We do not warrant that Din will be uninterrupted, error-free, or compatible with your device, or that its readings will be accurate, reliable or fit for any particular purpose.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits any non-excludable statutory right you have as a consumer — including under the Consumer Protection Act, 2019 in India.
9. Limitation of liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or connected with your use of or inability to use Din — whether in contract, tort (including negligence), strict liability or otherwise, and even if we have been advised of the possibility of such damages.
Without limiting the above, we are not liable for any harm arising from reliance on a reading, including hearing damage, a disputed noise complaint, a failed inspection, or any occupational or regulatory consequence.
Where liability cannot lawfully be excluded, our total aggregate liability arising out of or relating to Din is limited to the greater of (a) the amount you paid us for Din, which is zero, or (b) INR 1,000.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.
10. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your misuse of Din, your breach of these Terms, or your violation of any law or third-party right — including any claim arising from how you used or shared an exported report.
11. Termination
These Terms apply for as long as you use Din. You may end them at any time by uninstalling the app. We may suspend or terminate your licence if you materially breach these Terms. Sections that by their nature should survive termination — accuracy disclaimers, warranty disclaimers, limitation of liability, indemnity and governing law — survive it.
12. Additional terms for the Apple App Store
The following applies where you obtained Din from the Apple App Store, and is required by Apple. In the event of any conflict, this section prevails over the rest of these Terms for App Store users.
- These Terms are between you and BaruzoTechonly, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for Din and its content.
- Your licence to use Din is limited to a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation whatsoever to furnish any maintenance or support services in relation to Din.
- If Din fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. Apple has no other warranty obligation whatsoever with respect to Din, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to Din or your possession and use of it, including product liability claims, any claim that Din fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of a third-party claim that Din or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
13. Additional terms for Google Play
Where you obtained Din from Google Play, your use is additionally subject to the Google Play Terms of Service. These Terms are between you and BaruzoTech only, not with Google. Google is not responsible for Din, and is not a party to these Terms.
14. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict of law principles. Subject to the paragraph below, the courts at [CITY], India have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
If you are a consumer resident in a jurisdiction whose law gives you the right to bring proceedings in your local courts, or grants you protections that cannot be overridden by agreement, nothing in this section removes those rights.
Before starting formal proceedings, please contact us at info@baruzotech.ae. Most issues are resolved quickly and informally.
15. General
If any provision of these Terms is held unenforceable, the rest remain in force and the unenforceable provision is modified to the minimum extent necessary to make it enforceable. Our failure to enforce a provision is not a waiver of it.
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding Din. You may not assign them; we may assign them in connection with a merger, acquisition or sale of assets.
We may update these Terms. When we do, we will change the effective date at the top of this page, and for material changes we will give notice in the app or on this site. Continuing to use Din after a change takes effect means you accept the revised Terms.
